Release of Liability Waiver - Effective July 2015

PLEASE READ THE FOLLOWING INFORMATION BEFORE PARTICIPATING IN ANY YOGA OR MEDITATION ACTIVITY WITH UNITED WE OM. 

YOU CANNOT PARTICIPATE IN ANY UNITED WE OM ACTIVITY OR EVENT WITHOUT AGREEING TO THE TERMS BELOW.

Assumption of Risk: I, the undersigned, am aware that there are significant risks involved in yoga and meditation training, including but not limited to, the physical training inherent to all yoga exercise activities, also known as Asanas, and that my participation in any such yoga or meditation training program, class or event, carries with it the potential for death, injury, and/or property damage.  The risks include, but are not limited to, falls which can result in serious injury or death; injury or death due to carelessness, negligence or gross negligence on the part of myself, the instructor, or other people around me; injury or death due to improper use or failure of equipment; strains and sprains; risks caused by terrain, facilities, temperature, weather, condition of participants, equipment, vehicular traffic, actions of other people including, but not limited to, participants, volunteers, spectators, instructors and lack of hydration.  These risks are not only inherent to yoga and meditation training but are also present for volunteers and spectators.  I am aware that any of these above mentioned risks may result in serious injury or death to myself.  I willingly assume full responsibility for the risks that I am exposing myself to and accept full responsibility for any injury or death that may result from participating, volunteering or watching any United We Om yoga or meditation training, class or event.  I realize that liability may arise from negligence or carelessness by the persons or entities being released, from dangerous or defective equipment or property owned, maintained or controlled by them or because of their possible liability without fault.

Release of Liability: I acknowledge that I am willingly participating in these activities and that I have assumed all risks as described above. In consideration for my being allowed to participate in the activities offered by United We Om, I, the undersigned, hereby release United We Om, the instructor and the hosting organization, their principals, agents, employees, and volunteers from any and all liability, claims, demands, actions or rights of action, which are related to, arise out of, or are in any way connected with my participation in this yoga or meditation program, class or event, including those allegedly attributed to the negligent acts or omissions of the above mentioned parties. This agreement shall be binding upon me, my successors, representatives, heirs, executors, assigns, or transferees, in perpetuity.  If any portion of this agreement is found to be or held invalid, I agree that the remainder of the agreement shall remain in full legal force and effect.  

Indemnification of United We Om: I, the undersigned, realize that there are risks involved in the types of activities offered by United We Om.  Therefore, I accept full financial responsibility for any injury that I may cause either to myself or to any other participant due to my negligence. Should the above-mentioned parties, or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to reimburse them, in full, for such fees and costs.  I further agree to indemnify and hold harmless United We Om and the hosting organization, their principals, agents, employees and volunteers from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in the activities offered.

Image Release:  I grant my permission to United We Om and any transferee or licensee, to utilize any photographs, motion pictures, recordings or other references or records of today’s yoga or meditation class, event or program which may depict, record or refer to me (“Likeness”) for any purpose, including commercial use by the released parties, their sponsors and their licensees.  This permission is for use anywhere in the world and on the Internet for an unlimited period of time.  I understand and agree that I will not be compensated or receive any additional consideration for consenting to the use of my Likeness and that I will not be given a chance to receive, inspect, review or approve the promotional or marketing material, messages and/or content that may use my Likeness. 

Arbitration & Governing Law: The laws of the State of New York shall govern this agreement and venue for any court proceeding shall be in the State of New York and any right to jury trial shall be waived. I agree that my sole remedy for any dispute, whether in contract, tort, or otherwise, with United We Om is to submit to binding arbitration with an arbitrator within six months of the incident giving rise to the cause of action, even if that time is less than the applicable statute of limitations.  In the event of arbitration, I will pay half of the costs of the arbitrator and any other costs of arbitration, and I will be responsible for all of the costs for my own legal counsel.

I understand and intend that this document act as the broadest and most inclusive assumption of risk, waiver, release of liability, image release, agreement not to bring suit and indemnity. 

I have read and understood the foregoing assumption of risk and release of liability and I understand that by signing it I am obligated to indemnify the parties named for any liability for injury or death of any person and damage to property caused by my negligent or intentional act or omission.

I acknowledge that I have no physical impairments, injuries, or illnesses that will endanger me or others participating in the yoga or meditation training or program.

I understand my own physical condition and limitations and I am sufficiently self-aware to stop any activity before I become ill or injured.

I am aware that there is no obligation for any person to provide me with medical care during the class, event or program and there may be no aid station or individuals qualified to render medical care.  In the event that medical care is rendered to me, I consent to that care if I am unable to give my consent for any reason at the time the care is rendered.

I accept full responsibility for any equipment loaned to me as part of my participation in this yoga or meditation program, class or event and I commit to returning them in the same good working order.

I acknowledge that I am willingly participating in these activities and that I have assumed all risks as described above.

I understand that by signing this Waiver of Liability form I am waiving valuable legal rights.

If the participant is under the age of 18:  I am signing on behalf of a minor child and I also give full permission for any person connected with United We Om or the hosting organization to administer first aid deemed necessary, and in case of serious illness or injury, I give permission to call for medical and or surgical care for the child and to transport the child to a medical facility deemed necessary for the well being of the child.
